{"id":1156,"date":"2026-07-25T17:39:55","date_gmt":"2026-07-25T17:39:55","guid":{"rendered":"https:\/\/relocationacrossamerica.com\/?p=1156"},"modified":"2026-07-25T17:39:55","modified_gmt":"2026-07-25T17:39:55","slug":"court-ag-paxton-didnt-prove-abortion-claims","status":"publish","type":"post","link":"https:\/\/relocationacrossamerica.com\/?p=1156","title":{"rendered":"Court: AG Paxton didn\u2019t prove abortion claims"},"content":{"rendered":"<section>\n<p>A Texas appeals court has handed Attorney General Ken Paxton a setback in one of the state\u2019s highest-profile abortion enforcement cases, ruling that prosecutors failed to present enough evidence to justify shutting down the clinics of a Houston-area midwife accused of illegally providing abortions.<\/p>\n<p>Read more <a href=\"https:\/\/relocationacrossamerica.com\/?p=1154\">\u201cPresident Curtis\u201d is a \u201cRick and Morty\u201d spinoff to believe in<\/a><\/p>\n<p>In a decision issued Thursday, the Fifteenth Court of Appeals  a lower court\u2019s injunction against midwife Maria Margarita Rojas and her clinics, finding that the state relied largely on affidavits filed in a parallel criminal case rather than admissible evidence in the separate civil proceeding.<\/p>\n<p>\u201cThe trial court abused its discretion by considering incompetent evidence in support of the temporary injunction,\u201d the three-judge panel wrote.<\/p>\n<p>The ruling does not dismiss the underlying allegations or the criminal charges against Rojas, who in March became the first person charged under Texas\u2019 near-total abortion ban. Prosecutors allege she illegally performed abortions and practiced medicine without a license. Rojas has pleaded not guilty.<\/p>\n<p>Paxton\u2019s office filed the civil lawsuit shortly after the criminal charges were announced, seeking to permanently close Rojas\u2019 clinics and impose financial penalties. The appellate court concluded, however, that the state failed to meet the legal standard necessary to support the injunction because much of its evidence could not be considered in the civil case.<\/p>\n<p>The attorney general\u2019s office said it plans to appeal the decision to the Texas Supreme Court.<\/p>\n<p>Read more <a href=\"https:\/\/relocationacrossamerica.com\/?p=1152\">Trump at WHCD: \u201cThe show must go on\u201d \u2014 then \u201cripping\u201d into the press<\/a><\/p>\n<p>The Center for Reproductive Rights, which represents Rojas, welcomed the ruling, saying the state had failed to produce evidence supporting its claims and arguing the injunction should never have been granted. The organization also noted that the criminal prosecution remains pending.<\/p>\n<p>Although the decision technically removes the court order shuttering the clinics, Rojas\u2019 attorneys said the facilities are not expected to reopen while the criminal case continues.<\/p>\n<p>The case has drawn national attention as one of the first major tests of Texas\u2019 abortion ban since the Supreme Court\u2019s 2022 decision overturning Roe v. Wade.
